ALGEMENE VERKOOPSVOORWAARDEN TICKETS SOUTH OF HEAVEN EVENTS

1 Voorafgaand
Deze algemene voorwaarden beheersen de ticketverkoop, de totstandkoming van bijhorende overeenkomst en de wederzijdse rechten en plichten van KOPER/BEZOEKER, TICKETVERDELER en ORGANISATOR van een SOUTH OF HEAVEN event
Met de KOPER/BEZOEKER wordt in de eerste plaats bedoeld de persoon op wiens naam een ticket wordt gereserveerd en/of wordt aangekocht en/of de persoon die het event bezoekt.
Met de TICKETVERDELER wordt bedoeld Ticket Script / Eventbrite / ...
Met de ORGANISATOR wordt bedoeld SOUTH OF HEAVEN
Deze algemene voorwaarden maken integraal deel uit van de overeenkomst die tot stand komt ingevolge de reservering van één of meerdere tickets voor het event.
De bepalingen inzake ‘Privacybeleid’ en ‘Hoe online reserveren’, maken integraal deel uit van deze algemene voorwaarden.
De KOPER/BEZOEKER die één of meerdere tickets reserveert, erkent expliciet deze algemene voorwaarden integraal te hebben gelezen en aanvaard.
2 Reserveringsmodaliteiten
Elke reservering gebeurt pas na ontvangst van betaling van de verschuldigde geldsom.
Het aanbod tot reservering is van kracht in de mate dat de vermelde betalingstermijn wordt gerespecteerd.
Deze termijn zal zeer streng toegepast worden bij de naderende uitverkoop van een evenement of van een prijscategorie binnen een evenement.
De TICKETVERDELER heeft het recht om dit aanbod, zelfs ingeval van laattijdige betaling, toch door een reservering te laten volgen indien de voorraad beschikbare tickets van een prijscategorie dit toelaat.
De service- en administratiekosten zijn in ieder geval definitief verworven door de TICKETVERDELER.
Alle btw en taksen zijn ten laste van de KOPER/BEZOEKER.
De persoon of firma die de reservering doet, wordt beschouwd als opdrachtgever en staat borg voor de betaling van de reservering, zelfs wanneer deze aan een derde moet worden opgesteld en toegezonden.
Het verzakingsrecht is niet van toepassing gezien de dienst, c.q. de reservering van de tickets, onmiddellijk wordt uitgevoerd.
3 Eigendom en doorverkoopverbod
Elke vorm van namaak (inclusief doch niet uitsluitend nadruk of nabootsing), onder welke vorm dan ook en met behulp van om het even welk procédé, is strikt verboden en zal gerechtelijk vervolgd worden.
Tickets mogen niet doorverkocht worden. De tickets die worden doorverkocht, geven geen recht op toegang tot het FESTIVAL. De ORGANISATOR en/of de TICKETVERDELER behoudt zich tevens het recht voor om tickets te annuleren zodra wordt vastgesteld dat ondanks dit verbod tickets te koop worden aangeboden. De kosten als gevolg van de annulering zullen worden verhaald op de KOPER/BEZOEKER.
Tickets mogen niet voor commerciële of promotionele doeleinden gebruikt of aan derden verschaft worden, zonder schriftelijke toestemming van de TICKETVERDELER of de ORGANISATOR.
Identiteitscontrole van de KOPER/BEZOEKER door de ORGANISATOR of de TICKETVERDELER is ten allen tijde mogelijk.
Enkel de eerste aanbieder van het originele ticket wordt toegang verleend tot het event. De houder van gekopieerde tickets zal bijgevolg de toegang worden geweigerd.
4 Aansprakelijkheid
De inrichting van het event (waaronder doch niet uitsluitend de samensteling van het programma, datum en plaats van de verschillende optredens, etc.) behoort tot de verantwoordelijkheid van de ORGANISATOR met uitsluiting van de TICKETVERDELER die slechts aansprakelijk is voor de ticketverkoop en de afhandeling ervan.
Wijzigingen in de programmatie geven geen aanleiding tot gehele of gedeeltelijke terugbetaling van het ticket. De ORGANISATOR is in geen geval aansprakelijk voor de stopzetting en/of afgelasting van het event door overmacht.
Tickets worden noch terugbetaald, noch geruild voor een ander evenement of festivaldag.
Verlies of diefstal van het ticket behoort tot de verantwoordelijkheid van de KOPER/BEZOEKER en geeft geen aanleiding tot vervanging of terugbetaling.
Aanvullende regelingen ivm verplaatsing naar het FESTIVAL, voedingsmiddelen en verblijfskosten die de KOPER/BEZOEKER op eigen initiatief heeft getroffen, zijn ten laste van de KOPER/BEZOEKER. Het event is niet aansprakelijk voor vergeefse kosten bovenop de prijs van het/de ticket(s) en de hieraan verbonden reserveringskosten.
5 Overige rechten, plichten en aansprakelijkheden van de KOPER/BEZOEKER en ORGANISATOR van het event
Betreding van het event locatie impliceert instemming met alle preventieve en controlerende maatregelen die de ORGANISATOR of de veiligheidsploeg neemt met inbegrip van mogelijke aftasting en onderzoek van tassen. Niet naleving van deze maatregelen leidt tot weigering of intrekking van toegangsrecht.
Officiële verkoop van t-shirts en souvenirs geschiedt uitsluitend binnen het festivalterrein.
De ORGANISATOR en haar eventuele mede-organisatoren kunnen niet aansprakelijk gesteld worden voor eventuele schadegevallen op de eventlocatie , de camping en parkeerterreinen.
Als er tv-opnames worden gemaakt tijdens het event. De kans bestaat dat de KOPER/BEZOEKER wordt gefilmd. De KOPER/BEZOEKER gaat akkoord met het gebruik van deze beelden door het event en haar mediapartners. Camerabewaking zou ook kunnen volgens de wet van 21 maart 2007.
De ORGANISATOR en/of TICKETVERDELER behoudt zich het recht voor om de identiteit van de festivalganger op ieder ogenblik te verifiëren.
De artiesten, de ORGANISATOR en haar mede-organisatoren kunnen niet aansprakelijk worden gesteld voor schade, verlies of diefstal noch voor om het even welk gebeurlijk ongeval.
Het is uitdrukkelijk verboden enige promotionele of commerciële activiteit te ontplooien op de event locatie zonder de voorafgaande schriftelijke toelating van de ORGANISATOR. Behoudens schriftelijke toestemming van de ORGANISATOR is elk commercieel gebruik van de naam of het logo van het event zelf of de aantredende artiesten strikt verboden.
Kledij en/of overige (zichtbare) uiterlijke kenmerken die een expliciete politieke, sociale beweging of groepering uitdrukken, zijn verboden.
6 Betwistingen
Betwistingen omtrent bestellingen dienen aan de TICKETVERDELER per aangetekend schrijven kenbaar te worden gemaakt ten laatste acht dagen na ontvangst van het verzoek tot betaling.
Deze algemene voorwaarden (en eventuele betwistingen dienaangaande) worden uitsluitend beheerst door Belgisch recht.
Eventuele geschillen betreffende deze algemene voorwaarden zullen worden voorgelegd aan de bevoegde rechtbank conform de bepalingen uit het Gerechtelijk Wetboek.

1 Prior

2 Reservation Modalities

3 Ownership and sales ban

4 Liability

5 Other rights, obligations and liabilities of the BUYER / VISITOR and ORGANIZER of the event

6 Disputes
